Bill 9 was approved by the Maui County Council and signed into law on December 15, 2025. The ordinance phases out transient vacation rental use in A-1 and A-2 apartment-zoned districts, including many properties commonly referred to as Minatoya List properties.
The key issue now is not whether Bill 9 passed. It did. The key issue is whether Bill 88, the proposed H-3/H-4 hotel zoning ordinance, will pass and later give certain Minatoya properties a pathway to seek hotel zoning.
Properties that are already properly hotel-zoned are generally in the safer category because they are not relying on the Minatoya List exemption for short-term rental use in apartment zoning.
This page focuses on Minatoya List properties because those are the properties directly at issue under Bill 9 and Bill 88. A complete list of already hotel-zoned Maui condominium properties should be verified against Maui County zoning records before publishing because zoning can be parcel-specific.
Recommended wording for owners: If your property is already in a hotel zoning district, Bill 9 may not affect short-term rental use in the same way it affects apartment-zoned Minatoya properties. However, owners should still verify the zoning and permitted use for their specific unit or parcel.

If Bill 88 passes, it would not automatically remove these deadlines for a specific property. A property would still need to complete a separate rezoning process into the applicable H-3 or H-4 district.
