Contingencies are the buyer’s contractual protections during escrow. They create defined timeframes to investigate the property, review required documents, confirm financing, and address valuation or condition concerns before closing.

J-1 Inspection Period

This is your due diligence window, often 10 to 14 days after acceptance. Buyers typically obtain inspections, review disclosures, and investigate concerns. If issues arise, buyers may request repairs or credits, renegotiate terms, or cancel within the contingency period, subject to the contract.

M-1 Documents (Condo or HOA Properties)

Buyers receive and review association documents such as financials, house rules, bylaws, meeting minutes, and insurance. If the documents reveal a material concern, the buyer may cancel within the contingency timeframe, subject to the contract terms.

Seller’s Disclosure Statement

Sellers provide written disclosures regarding the property’s known condition. Buyers have a defined review period. If a disclosure raises a material concern, this contingency allows time to evaluate options within contract deadlines.

Termite Inspection

Typically arranged by the seller, this inspection evaluates active infestation or damage. Many loan programs require a clear termite report prior to closing.

Appraisal Contingency

If the appraisal is below the purchase price, buyers may renegotiate, contribute additional cash, or cancel if financing is denied due to the appraisal, subject to the contract.

Financing Contingency

Protects the buyer if financing cannot be obtained despite good-faith efforts and lender compliance.

Surveying and Staking

Used to confirm boundary lines, lot size, setbacks, and encroachments. If a material issue is discovered, buyers may negotiate or cancel within the contingency period.
