Real estate closings in Hawai‘i follow a two step structure. The official closing date is the date the transaction records with the State of Hawai‘i Bureau of Conveyances on O‘ahu. Recording, not document signing, is what legally transfers ownership.

Because Hawai‘i is a multi island state, signed documents are often executed on one island and then sent to O‘ahu for recording. As a result, buyers and sellers usually sign documents before the actual recording date. On the mainland, these steps often occur on the same day.

Standard Hawai‘i Association of Realtors purchase contracts define closing as the date when all conveyance documents are recorded with the Bureau of Conveyances. This distinction is important when coordinating possession, travel, funding deadlines, and move in plans.

What Does “Good Funds” Mean?

Hawai‘i is a good funds state. Escrow companies are prohibited from disbursing funds until final settlement funds have been received and verified by the financial institution holding the deposit, in accordance with Hawai‘i law.

In practice, this means all funds required to close, including buyer deposits and lender proceeds, must be received and confirmed as good funds by escrow at least two business days prior to the scheduled recording date. These funds must be immediately available for withdrawal and disbursement.

Loan documents typically require wet signatures. When a buyer or seller is off island, escrow can usually arrange a mobile notary to complete signing. Cash transactions may allow electronic signatures, but documents must still physically reach O‘ahu for recording.

As closing approaches, your real estate agent coordinates closely with escrow and your lender, if applicable, to establish a clear signing, funding, and recording timeline that aligns with the contract and avoids last minute issues.
